Terms of Service

By accessing or using PEGTrace, you agree to these Terms and to our Privacy Policy, Honest-Scope Disclaimer, and Acceptable Use Policy. If you do not agree, do not use the service.

1. What we are

PEGTrace, operated by PEGTrace LLC (a New Jersey limited liability company), is a web application that records, hash-chains, and packages fraud-investigation evidence for use by financial institutions, law enforcement, and their counsel. PEGTrace is a workflow and evidence-integrity tool. It does not provide legal, financial, tax, or investment advice, does not identify individuals, does not render fraud verdicts, and does not recover funds.

2. Institutional use and eligibility

Access is limited to institutional analysts, including banks, credit unions, exchanges, licensed counsel, and law enforcement personnel. You must be authorized by your institution to access, review, and act on fraud-case data, and you must be at least 18 years old and legally able to enter this agreement. You are responsible for your login credentials and for all activity under your account. Enable multi-factor authentication where available and keep credentials confidential.

3. Subscriptions, billing, and cancellation

Paid tiers renew automatically at the interval you selected until cancelled. You can cancel any time from your account settings; cancellation stops future charges but does not refund the current period. Prices, features, and limits may change with reasonable notice. Refunds are handled case-by-case, except where required by law.

4. Acceptable use

You agree not to: (a) reverse-engineer, scrape, or resell the service; (b) share, sublicense, or expose your account to third parties; (c) use PEGTrace to violate laws or the terms of any custodian or platform you interact with; (d) upload malicious code or attempt to disrupt the platform; (e) misrepresent PEGTrace output as a fraud verdict, an identification of an individual, or legal advice; or (f) use PEGTrace to charge fraud victims fees for recovery, or otherwise operate as a third-party 'recovery service.' 5. Content and intellectual property

All application code, ledger logic, packaging templates, framework rules, and branding are owned by PEGTrace LLC and its licensors. You retain ownership of the case data, identifiers, notes, and attachments you enter; you grant us a limited license to store and process that content to operate the service and to improve it in aggregated, de-identified form.

6. AI features (Coach)

The Coach uses a large language model from Anthropic to explain how the application works. The Coach receives only route context and the messages you type. It does not receive case data. Coach output can be wrong or incomplete; you are responsible for verifying anything before acting on it. Do not paste victim PII, credentials, or privileged material into the Coach.

7. On-chain and third-party data

On-chain data (Bitquery) and third-party intelligence signals (including breach-lookup, IP intelligence, and token-contract analysis providers) are investigative leads, not proof. Distance from a source weakens relevance. Blockchain transactions are final and cannot be reversed on-chain. Naming an account owner requires the receiving custodian's KYC records via subpoena. Third-party providers are governed by their own terms.

8. No advice, no verdict, no identification

Nothing in PEGTrace is legal, financial, tax, or investment advice. PEGTrace does not render fraud verdicts, does not identify individuals, does not verify external findings, and does not recover funds. Investigative determinations and legal decisions rest with you and your institution. We are not your fiduciary.

9. Disclaimer of warranties

The service is provided 'as is' and 'as available,' without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

10. Limitation of liability

To the maximum extent allowed by law, PEGTrace LLC and its officers, employees, and affiliates are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or investigative losses arising from your use of the service. Our total aggregate liability will not exceed the fees you paid in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold PEGTrace LLC harmless from claims arising out of your misuse of the service, violation of these Terms, or infringement of third-party rights.

12. Termination

We may suspend or terminate access for material breach, prolonged non-payment, or activity that endangers the service, another user, or a fraud victim. You may stop using the service at any time.

13. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. You agree to attempt informal dispute resolution first by emailing support@pegtrace.com. Unresolved disputes will be settled by binding arbitration in New Jersey, except that either party may seek injunctive relief in court for intellectual-property claims.

14. Changes

We may update these Terms; material changes will be posted at /terms with an updated 'Last updated' date. Continued use after the effective date is acceptance.
